1. Website Design

1.1 Design

WebWorX creates look-and-feel designs and flexible layouts that adapt to the capabilities of many devices and screen sizes. WebWorX creates designs iteratively and uses predominantly HTML and CSS rendering to requirement to mock up every template as a static visual. WebWorX may use static visuals to indicate a look-and-feel direction (e.g. colour, texture and typography), which is termed 'design atmosphere.'

You will be provided with ample opportunity at agreed intervals to review the work of WebWorX and provide feedback.

WebWorX may make use of Wordpress to build a site. All Wordpress sites must subscribe to a maintenance package.

1.2 Text Content

Your website will require a Terms & Conditions and a Privacy Policy page.

WebWorX is not responsible for writing or inputting any text copy. If you require WebWorX to write new content or input text for you, a separate costing will be provided to you for sign-off prior to commencement of work.

1.3 Photographs

You should supply graphic files in an editable, vector digital format. You should supply photographs in a high resolution digital format. If you choose to buy stock photographs, WebWorX can suggest stock libraries. If you require WebWorX to search for photographs for you, a separate costing will be provided to you for sign-off prior to commencement of work.

1.4 Browser Testing

Browser testing no longer means attempting to make a website look the same in browsers of different capabilities or on devices with different size screens. It does mean ensuring that a person's experience of a design should be appropriate to the capabilities of a browser or device.

1.4.1 Desktop Browser Testing

WebWorX tests output in current versions of major desktop browsers including those made by Apple (Safari), Google (Chrome), Microsoft (Internet Explorer/Edge), Mozilla Firefox and Opera. If you need an enhanced design for an older browser, a separate costing will be provided to you for sign-off prior to commencement of work.

1.4.2 Mobile Browser Testing

Testing popular small-screen devices is essential in ensuring that a person's experience of a design is appropriate to the capabilities of the device they're using. WebWorX tests output in Google Chrome, Android and Firefox.

WebWorX does not test Blackberry, Opera Mini/Mobile, Windows Phone or other mobile browsers. If you require such testing a separate costing will be provided to you for sign-off prior to the commencement of work.

2. Third Party Applications

There are instances whereby it is necessary to use third party applications for certain functions. Sometimes these Third Parties change their terms and conditions and the applications may cease to operate. This is beyond the control of WebWorX, who are not held responsible in such instances. If it is possible to return functionality, WebWorX will do so upon request, whereby standard quoted rates will apply.

Third parties include, but are not limited to Hetzner (hosting and emails), Wordpress (including themes and plugins), email branding, printing of business cards and pamphlets.

3. Domains

WebWorX will register the domain name of your choice, depending on availability, in your name. Renewals occur automatically each year. Should you decide to cancel the domain, you need to provide a minimum of 1 month's notice in writing to WebWorX before the renewal occurs. You will be held liable for any outstanding renewal fees should you fail to cancel within the 1 month notice period.

4. Emails

WebWorX can set up emails for your domain. The number of mailboxes is dependent on the hosting package.

It is your responsibility to back up your mails and periodically clean out your mailbox(es) to avoid exceeding allotted disk usage.

WebWorX will generate a strong password for each mailbox and send it to you in a manner agreed by both parties. WebWorX will then destroy its copy of the password. It is your responsibility to keep the password in a safe place.

Please note: WebWorX can only reset passwords (by written request from an authorised email) as passwords are not stored by WebWorX.

5. Hosting

Hosting fees apply in any of the following instances:

  1. Login details are requested for either the Control Panel or FTP access
  2. One or more mailboxes are created
  3. Your website is uploaded

WebWorX acts as a reseller for Hetzner and offers various hosting packages. As such, you need to agree to their Terms of Service, Acceptable Use Policy and Privacy Policy.

WebWorX's hosting and email support is limited and is largely dependent on the Hetzner support team. WebWorX retains login details to the server and File Transfer Protocol (FTP) as these are required to execute required functions. Should you require these details for any reason, WebWorX, waivers any responsibility for the security of your site and/or emails and will charge for any restoration work that may need to be undertaken.

WebWorX office hours: Monday — Friday, 08:00 — 17:00.

6. Website Advertising

Listings and banners are automatically renewed each year. Cancellation needs to be done in writing, with a minimum of one month's notice before renewal. Failure to cancel within the notice period will result in you being liable for renewal fees.

Where applicable, a 10% commission will be charged on bookings made through Nightsbridge through WebWorX web portals. All bookings made via the Nightsbridge system will be treated as confirmed bookings. The cancellation policies of the individual properties, as entered into the Nightsbridge setup program by each property, must be adhered to. Any cancellations need to be reported to WebWorX immediately in writing.

7. Graphic

Any graphic work, including, but not limited to, business cards, pamphlets, email branding and artwork for advertising in other mediums will be checked by you and signed off before WebWorX distributes it for printing/publishing. WebWorX will not be held liable for any mistakes that may occur after the project has been signed off as it is deemed out of WebWorX's control.

8. Legal

WebWorX will not be held liable to you or any third-party for damages, including lost profit, lost savings or other incidental, consequential or special damages, even if you have incurred them or advised WebWorX of same. If any provision of this contract shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this contract and shall not affect the validity and enforceability of any remaining provisions.

9. Copyrights

You guarantee that all elements of text, images or other artwork you provide are either owned by yourselves, or that you have the appropriate permission to utilise them.

When your final payment has cleared, copyright will be automatically assigned as follows: You own the graphics and other visual elements that we create for you for your project. You also own the text content, photographs and other data you provided or have loaded, unless someone else owns them. Please ensure that you keep originals as WebWorX are not required to keep any copies of files provided. WebWorX will own the markup, CSS and other code, and we license it to you for use on this project only. This does not prevent you from moving the website or maintenance thereof to another developer; you may however need to purchase additional software licenses for commercial extensions, themes and/or Stock Images which are licensed to WebWorX, in the event that you want to run upgrades of your system/website. WebWorX reserves the right to display and link to your project as part of WebWorX's portfolio and to write about it e.g. in websites, magazine articles, books alongside other media.

10. Payment

Non-payment of invoices within agreed schedule and timelines will result in the immediate suspension of services. An administration fee will be applicable to restore services in each instance whereby non-payment within an agreed schedule occurs.
